Does tenant deserve his rent deposit refund?!

    What's the point in knowing that Atlanta?

    It's a good advice wherever you are, document the place and reach an agreement so that at the end of the contract everything is clear.

    Well, he should receive the refund if he hasn't damaged the property because deposits are meant to be refunded, but also to give warranty to the owners that they will not be at a loss.

    Unfortunately, that is what happens when you are the landlord there is always going to be that tenant who would give you trouble. You just have to think about getting that rent so you can pay your bills.

    I do believe that tenants definitely require their rent back. It is very important to not think about how badly the things can turn if the rent is it given back.

    I really think it all depends on the amount of damage that is done to the home. If someone caused an immense amount of damage to the property then it makes sense for them to keep the money in order to satisfy the cost of damage repair. I personally am not fond of tenants who break walls or damage the floors then act as though they deserve every penny of their money back after there is damage to the floors.

    I do believe that tenant deserve their rent deposit. It is true that it can be really useful if the refund option is available.

    I won't disagree with what you've said but in the event destruction has taken place...then as the landlord its my right to withhold the rent deposit...do my repairs and explain to the tenant what took place and how the rent deposit was used up....just saying :)

    I couldn't agree with you more. Why should you have to pay for the repairs out of pocket to get the property back to it's original luster? If they stayed in the home, caused even slight damage then you should be able to provide them with a rolling list of charges for each repair.

    I remember Determined2014, giving a well-detailed plan/advice on how to handle such a situation, say, before the tenant steps into the said house, the best thing the landlord can do is write up things that are faulty and need repaired, take photos as well...then go on about with the repairs and take photos afterwards...the tenant enters the premises...in the event of leaving the premises, the documents/proof that the landlord has...{s}he uses that against the tenant, if at all the tenant has destroyed anything...i found that to be quite some advice... am using it currently :)

    Keep in consideration that the deposit is not only for damages to the property but is also for any liability such as the tenant moving out earlier than the lease specifies. If he met the terms of the lease then consider what a judge would say about the evidence you could provide in court, because that's the only way he's getting anything back.
