Does tenant deserve his rent deposit refund?!

    Cover Your Ass material. Not exactly the most prim and proper term but it's fitting, no? Like any investment in life, it's covering all sides and having safety in a backup plan/evidence.

    The meaning behind the security deposit is to take care of any repairs needed to the property subsequent to the tenants time there. If the amount of repairs is numerous, provide the tenant with an itemized list or invoice for the repairs needed, indicate that the invoice is paid in full due to the security deposit being provided.

    They will not have a legal leg to stand on, and you will have all of the proof you need to defeat them if the wish to take it to court (which they will not if they damaged the property). Always take pictures before and after the property is leased to any tenant. Always keep documentation.

    Seconding what healthandfitness said, I had a landlord do the exact same thing to me because I felt the damages were minuscule compared to my security deposit. Boom, lawyered, out $1100

    Who does he claim did the damage then? Is he saying that it was already like that?

    Please tell me you took photos before you rented!?

    That is a painful lesson learned but will do so in the future :(

    Unfortunately not...learning a bitter painful lesson here, good thing everything is in writing at the police and chief's camp, reviewing is tomorrow in that regard...lets see how it goes.

    Please do keep us updated. It's shameful what he's trying to do, but of course if it goes South, you know what to do in the future I suppose.

    I have rented numerous times and always try my best to keep the place in the best condition possible. If the tenant has destroyed the place intentionally or has not cared for it beyond the usual normal wear and tear, I would say that you should use their deposit for the repairs. People should have respect, especially if they're renting. If they own the place they can do whatever they want. I know this is always a chance you take with tenants, but I just think people need to take more responsibility.
