A very complex question

You are in the process of registering a house in your name (it was giving to you by will) and a family member is in that house, and does not want to get out, what is the most amicable way to get that family member out of the house?

 

I don't see many other friendly ways to sort this out except.
a) you selling the property to them
b) a rental agreement where you are the landlord and they are the tenant.

If you plan on living in that house then obviously the above won't work. In that case, they really have no choice to leave as the house is yours.

 

Thank you for your suggestions @Crimsonghost747, I find them very useful, however, the unfortunate situation that will not see these two suggestions working is that; the person in the house doesn't value the property much and has the house in disrepair, so asking the person to buy the house is tantamount to asking for further destruction. And the same thing would result if a rental agreement would be in place, the only thing that can be done to peaceably resolve this conundrum, is for the person to leave and never return. And that's the grappling issue.

 

Ok so this person definitely needs to go. In that case, apart from talking sense into them, there is not much you can do yourself. Try talking to them and explaining the situation... it's always better if you can sort it out yourselves. But if he/she refuses to leave... then you need to get him/her evicted. It's not a pretty way of taking care of it since you need to involve the law, but it's the only option I see if they refuse to leave.

 

JR Ewing answers the question the most honorable way fit...sometimes amicability will have to be shoved in the back pocket and tackle this bull by the horns...another thing, if they are not respecting you, what makes you want to respect them back?

 

Yep, this is the only answer I can come up with, too... they "don't want to get out" of a property that's yours... and especially if you don't have a rent agreement with them, then I suppose it's trespassing and you'll need to evict them.

 

I would first discuss it with them, if they prove to be difficult, then I would get a lawyer and let then handle it from there, since it will only bring more dispute, because it is a family member and they would want to take advantage of you.

 

Tell them you are selling the house because you need the money.

Then don't sell the house.
