That lower minimum wage for servers who get a certain amount of their income in tips is perfectly legal and in accordance with the law in many states. Personally, if I was a server and had to choose between $7.25 to $9.25 an hour and no tips versus $2.13 an hour and a steady $100 to $200 a night in tips 5 nights a week, I'd choose the latter.
